1. Introduction

Welcome to HiddenOmen.com (“Site”). These Terms of Use (“Terms”) govern your access to and use of the Site, including all content, features, and functionality provided by Hidden Omen (“Hidden Omen,” “we,” “us,” or “our”).

By accessing or using the Site, you acknowledge and agree to be bound by these Terms, our Terms of Service, Privacy Policy, and all additional policies incorporated by reference.

If you do not agree, you must discontinue use of the Site immediately.

2. Ownership and Intellectual Property

All materials and content on the Site—including but not limited to text, artwork, graphics, product images, videos, logos, icons, trademarks, trade dress, and digital assets—are the exclusive property of Hidden Omen or its licensors and are protected by U.S. and international intellectual property laws.

You are granted a limited, revocable, non-exclusive license to access and use the Site for personal, non-commercial purposes only.

You may not:

  • Copy, reproduce, modify, distribute, or publicly display Site content

  • Create derivative works based on any Hidden Omen design or artwork

  • Republish, sell, or commercially exploit Site content

  • Remove copyright, trademark, or proprietary notices

  • Resell Hidden Omen products without written authorization

Unauthorized use may result in civil or criminal liability.

3. User Conduct

You agree not to use the Site in any manner that:

  • Violates applicable law

  • Infringes on the rights of Hidden Omen or any third party

  • Interferes with the Site’s security, infrastructure, or operation

  • Attempts to gain unauthorized access to accounts, systems, or data

  • Uploads viruses, malware, or harmful code

  • Uses automated tools (bots, scrapers, spiders, crawlers) to extract data

  • Impersonates any person or entity

  • Harasses or abuses Hidden Omen staff or customers

We reserve the right to suspend or terminate Site access for any violation of these Terms.

4. Accuracy of Information

While Hidden Omen strives to maintain accurate and up-to-date product descriptions, pricing, and imagery, we do not warrant that:

  • Product descriptions are complete or error-free

  • Colors displayed on your device match final product colors

  • Information on the Site will always be accurate or current

We reserve the right to correct errors, modify content, or update information at any time without prior notice.

Because all items are made to order, color variations, print tolerances, and minor discrepancies in placement are normal and not considered defects.

5. User Submissions & Reviews

If you submit or upload reviews, comments, photos, or other content (“User Content”), you grant Hidden Omen a:

Non-exclusive, worldwide, irrevocable, royalty-free, transferable, and sublicensable license
to use, reproduce, distribute, display, publish, and promote such User Content for any business purpose, including marketing, advertising, and social media.

By submitting User Content, you represent and warrant that:

  • You own or control all rights to the content

  • The content is accurate and lawful

  • The content does not infringe any intellectual property rights

  • The content does not contain personal data of others without consent

  • The content does not contain harmful, defamatory, obscene, or misleading material

We reserve the right to remove or reject User Content at our discretion.                                                                                                                                       

User Content includes any content posted on social media that tags Hidden Omen or is submitted to us for reposting.

6. Third-Party Links

The Site may contain links to third-party websites, services, or social media platforms. These links are provided for convenience only.

Hidden Omen does not endorse, control, or assume responsibility for:

  • Third-party content

  • Privacy practices

  • Security measures

  • Availability or performance

Accessing third-party sites is at your own risk.

You agree to comply with all applicable laws and regulations related to your use of the Site.

Hidden Omen operates exclusively under U.S. law, and nothing on the Site constitutes advice or assurance regarding international legal compliance.

To the fullest extent permitted by law:

  • Hidden Omen makes no warranties, express or implied, regarding:

9. Third-Party Trademarks & Non-Affiliation Disclaimer

Hidden Omen operates as an independent brand. We are not affiliated with, endorsed by, sponsored by, or approved by any third-party companies, manufacturers, or trademark holders.

Any trademarks, logos, brand names, images, or products belonging to third parties — including but not limited to footwear, apparel, accessories, sporting goods, equipment, or lifestyle items — remain the sole property of their respective owners.

From time to time, non–Hidden Omen products may appear in our marketing materials, promotional content, website imagery, or social media posts. These items are included strictly for styling, editorial, or visual presentation purposes. Their inclusion does not constitute or imply any partnership, approval, endorsement, sponsorship, or commercial association with Hidden Omen.

Hidden Omen does not sell, distribute, or represent any third-party products featured in our imagery, and no rights or permissions are claimed over the intellectual property of their respective owners.

10. Limitation of Liability

To the maximum extent permitted by law:

  • Hidden Omen shall not be liable for any indirect, incidental, consequential, special, or punitive damages.

  • Hidden Omen’s total liability for any claim shall not exceed the amount you paid (if any) in connection with your use of the Site.

Some jurisdictions do not allow certain limitations, and portions of this section may not apply to you.

11. Termination

We reserve the right, at our discretion, to suspend or terminate your access to the Site without notice for any violation of these Terms or conduct deemed harmful.

Upon termination, the license granted to you under these Terms will immediately cease.

Hidden Omen reserves the right to suspend or terminate access to the Site at any time for any reason.

12. Governing Law

These Terms are governed exclusively by the laws of the Commonwealth of Massachusetts, U.S.A., without regard to conflict-of-law principles.

You agree that any disputes shall be resolved in accordance with the dispute resolution terms set forth in our Terms of Service.

Hidden Omen does not consent to jurisdiction outside the United States.

13. EU / UK Visitors

If you access the Site from the European Economic Area (EEA) or United Kingdom, these Terms do not limit any mandatory rights granted under local consumer law.

14. Amendments

Hidden Omen may update or modify these Terms at any time. The updated version will be posted on the Site with an updated effective date.
