1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “customer,” or “user”) and Hidden Omen (“Hidden Omen,” “we,” “us,” or “our”) governing your access to and use of HiddenOmen.com (the “Site”) and all products and services offered by Hidden Omen (collectively, the “Services”).

By accessing the Site or placing an order, you agree to be bound by these Terms, along with our Terms of Sale, Return & Refund Policy, Shipping Policy, Privacy Policy, and all other referenced policies.

If you do not agree, you must discontinue use of the Site immediately.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of entering into a binding contract. By using the Services, you represent and warrant that you meet these requirements.

3. Nature of Products

All Hidden Omen products are made to order and manufactured by our contracted third-party fulfillment partners. As a result:

  • Production begins shortly after payment

  • Orders cannot be canceled or modified once production begins

  • All sales are final except for verified defects (see Return & Refund Policy)

Minor variations in color, placement, texture, or print alignment may occur due to production processes and are not considered defects.

4. Account Registration

You may create an account to streamline ordering. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account. Hidden Omen is not liable for unauthorized access resulting from your failure to secure your account.

You agree to provide accurate, complete, and current information at all times. We reserve the right to suspend or terminate accounts for fraud, misuse, or policy violations.

5. Orders, Pricing, and Availability

5.1 Order Acceptance

Orders are offers to purchase. An order is considered accepted once payment is authorized and the item has entered production.

We may reject or cancel orders for reasons including, but not limited to:

  • Product unavailability

  • Suspicion of fraud

  • Incorrect pricing or product information

  • Violation of these Terms

If an order is canceled before production begins, a full refund will be issued.

5.2 Pricing

Prices may change without notice. The price charged is the price displayed at checkout, including applicable taxes and shipping.

5.3 Incorrect Information

We reserve the right to correct any errors in pricing or descriptions and cancel any order affected by such errors.

6. Payment & Chargebacks

Payments are processed securely through third-party payment processors. By submitting an order, you authorize Hidden Omen to charge the total amount to your selected payment method.

Unfounded chargebacks (including those based on size issues, color variations, or buyer’s remorse) may result in:

  • Contesting the chargeback

  • Recovery of chargeback fees

  • Account suspension

Minor printing differences, color variations due to screen displays, and standard production tolerances do not constitute “not as described” claims.

7. Shipping, Delivery & Risk of Loss

Shipping times vary by location and are estimates only. Delivery timelines are not guaranteed.

Risk of loss transfers to the customer once the package is handed to the carrier.
However, as a courtesy, Hidden Omen replaces verified lost-in-transit shipments. See Shipping Policy for full details.

You are responsible for providing an accurate and complete shipping address. Hidden Omen is not liable for:

  • Carrier delays

  • Customs inspections

  • Incorrect or incomplete addresses

  • Unclaimed deliveries

8. Returns, Replacements & Refunds

Because all items are produced individually on demand, all sales are final except in cases of:

  • Defective items

  • Misprinted items

  • Damage during production or delivery

  • Lost packages verified through the carrier

Claims must be submitted within 30 days of delivery, or within 30 days of the estimated delivery date for lost shipments.

9. Third-Party Trademarks & Non-Affiliation Disclaimer

Hidden Omen operates as an independent brand. We are not affiliated with, endorsed by, sponsored by, or approved by any third-party companies, manufacturers, or trademark holders.

Any trademarks, logos, brand names, images, or products belonging to third parties — including but not limited to footwear, apparel, accessories, sporting goods, equipment, or lifestyle items — remain the sole property of their respective owners.

From time to time, non–Hidden Omen products may appear in our marketing materials, promotional content, website imagery, or social media posts. These items are included strictly for styling, editorial, or visual presentation purposes. Their inclusion does not constitute or imply any partnership, approval, endorsement, sponsorship, or commercial association with Hidden Omen.

Hidden Omen does not sell, distribute, or represent any third-party products featured in our imagery, and no rights or permissions are claimed over the intellectual property of their respective owners.

10. Intellectual Property

All content on the Site—including artwork, graphics, designs, text, images, product photos, logos, trademarks, and any other intellectual property—is owned by Hidden Omen or its licensors.

You may not:

  • Copy, reproduce, distribute, or modify any content

  • Create derivative works

  • Use the brand name, designs, or images for commercial purposes

  • Resell Hidden Omen products without written permission

Unauthorized use may violate copyright, trademark, or other applicable laws.

11. Prohibited Conduct

You agree not to:

  • Use the Site for unlawful purposes

  • Attempt to gain unauthorized access to any system or data

  • Interfere with or disrupt Site security

  • Use bots, scrapers, or automated tools

  • Upload malicious code

  • Use the Site in a way that harms Hidden Omen or other users

We reserve the right to restrict, suspend, or terminate access for violations.

12. Third-Party Services

The Site may link to external websites, applications, or services not controlled by Hidden Omen. We are not responsible for their content, privacy practices, or actions.

Use of third-party sites is at your own risk.

13. International Customers

Hidden Omen operates in the United States. All transactions are processed under U.S. law.

If you access the Site from outside the U.S., you are responsible for ensuring compliance with your local laws.
Hidden Omen does not consent to jurisdiction outside the United States.

EU / UK Withdrawal Rights

Because products are made to order and personalized for each customer, the 14-day right of withdrawal does not apply under Directive 2011/83/EU Article 16(c).
Your statutory rights regarding defects remain unaffected.

14. Disclaimers

The Services and all products are provided “as is” and “as available.”

To the fullest extent permitted by law, Hidden Omen disclaims all warranties, express or implied, including:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Accuracy of product images or colors

  • Continuous or error-free operation of the Site

Minor production variances are not defects.

15. Limitation of Liability

To the maximum extent permitted by law:

  • Hidden Omen shall not be liable for indirect, incidental, consequential, special, or punitive damages

  • Hidden Omen’s total liability for any claim shall not exceed the amount paid for the order in question

Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

16. Indemnification

You agree to indemnify, defend, and hold harmless Hidden Omen and its owners, employees, agents, contractors, and affiliates from any claims, losses, liabilities, damages, or expenses (including legal fees) arising from:

  • Violation of these Terms

  • Misuse of the Site or Services

  • Infringement of intellectual property

  • Violation of law

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Massachusetts, U.S.A., without regard to conflict-of-law principles.

Disputes may be resolved through:

  1. Informal resolution — contact us first

  2. Small claims court, or

  3. Binding individual arbitration in Massachusetts

Class actions and jury trials are expressly waived to the fullest extent permitted by law.

18. Changes to the Services or These Terms

We may update the Services or these Terms at any time. Updated versions take effect immediately upon posting. Continued use of the Site constitutes acceptance.
