Hidden Omen — Terms of Sale

Effective Date: November 2025

1. Overview

These Terms of Sale (“Terms”) govern all purchases made through HiddenOmen.com (“Site”) and form a binding agreement between you (“you,” “customer,” or “buyer”) and Hidden Omen (“Hidden Omen,” “we,” “us,” or “our”).

By placing an order, you agree to be bound by these Terms, our Terms of Service, Return & Refund Policy, Shipping Policy, and all related policies incorporated by reference.

If you do not agree, you must not place an order.

2. Made-to-Order Production

All Hidden Omen products are made to order and produced individually by our contracted fulfillment partners.

As a result:

  • Production begins shortly after payment is authorized

  • Orders cannot be canceled, modified, or refunded once production begins

  • All sales are final, except for verified defects, misprints, damages, or lost-in-transit shipments

Minor variations in color, print placement, texture, fabric tone, and production tolerances (including up to 2 inches of size deviation) are normal and not considered defects.

3. Order Acceptance

3.1 Receipt of Order Confirmation

When you place an order, you will receive an email confirming that your order was received. This confirmation does not signify acceptance.

3.2 Binding Acceptance

Your order becomes binding when:

  1. Payment is authorized, and

  2. The product enters production

At this stage, cancellations or changes cannot be guaranteed.

3.3 Order Refusal or Cancellation

We reserve the right to refuse or cancel orders at our discretion for reasons including, but not limited to:

  • Product unavailability

  • Errors in pricing or product descriptions

  • Suspicion of fraud or unauthorized activity

  • Violation of these Terms

If an order is canceled prior to production, any authorized payment will be refunded in full.

4. Pricing, Taxes & Fees

All prices are listed in U.S. Dollars (USD) unless stated otherwise.

We reserve the right to modify pricing, correct errors, or update fees at any time before your order enters production.

4.1 Taxes & Duties

Applicable sales tax, VAT, or other required charges will appear at checkout.

International customers are responsible for:

  • Import duties

  • Customs taxes

  • Brokerage fees

  • Any other applicable local charges

We cannot mark orders as “gifts” or understate customs values.

5. Payment Terms

Payment is due in full at checkout through one of our approved third-party payment processors.

By placing an order, you authorize Hidden Omen to charge your selected payment method for the total amount shown, including taxes and shipping fees.

5.1 Chargebacks

Unfounded or fraudulent chargebacks—including those based on:

  • Buyer’s remorse

  • Incorrect sizing

  • Color or print variation

  • Failure to read product details

may result in:

  • Contesting the chargeback

  • Recovery of chargeback-related fees

  • Account suspension

6. Shipping & Risk of Loss

Shipping estimates are provided as a courtesy and are not guaranteed. Delivery times may vary based on carrier performance, customs processing, and regional conditions.

6.1 Transfer of Risk

Risk of loss transfers to the customer once the order is handed to the carrier.

6.2 Lost Packages (Courtesy Replacement)

Although risk of loss transfers at shipment, Hidden Omen provides replacement orders for shipments confirmed lost-in-transit.

Claims must be submitted within 30 days of the estimated delivery date.

6.3 Incorrect Addresses

You are responsible for submitting a complete and accurate shipping address. We are not responsible for errors caused by:

  • Customer autofill

  • Typos or omissions

  • Device address caching

  • Carrier rerouting errors

Reshipment fees apply for:

  • Incorrect or incomplete addresses

  • Unclaimed packages

  • Refused deliveries

7. Delivery Delays

Hidden Omen is not liable for delays caused by:

  • Carriers

  • Customs agencies

  • Weather events

  • Supply chain disruptions

  • Global events outside our control

Delays do not constitute grounds for cancellation or refund.

EU/UK 30-Day Delivery Rule

If you are in the EU or UK, you acknowledge that Hidden Omen is a U.S.-based made-to-order brand and delivery may exceed 30 days during peak periods.
Local statutory rights remain unaffected where legally applicable.

8. Returns, Replacements & Refunds

Because all items are produced specifically for each customer:

All sales are final
Except in cases of:

  • Manufacturing defects

  • Misprints

  • Damage during production or delivery

  • Verified lost-in-transit shipments

Claims must be filed within 30 days of delivery, or within 30 days of estimated arrival for lost packages.

9. Promotions, Discounts & Gift Cards

Hidden Omen may offer promotions or digital gift cards.

Unless otherwise stated:

  • Promotions cannot be combined

  • Discounts have no cash value

  • Gift cards are non-refundable and non-transferable

  • Promotions may be modified or discontinued without notice

10. Title & Ownership

Title to items passes to you upon transfer of the package to the carrier.

This does not affect our courtesy replacement process for lost shipments.

11. Changes or Cancellations

Due to made-to-order production:

  • Orders cannot be canceled once production begins

  • Address changes may not be possible after submission

  • Hidden Omen is not required to modify or halt orders post-payment

We will attempt to accommodate requests when possible but cannot guarantee adjustments.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Hidden Omen is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages

  • Hidden Omen’s total liability for any claim shall not exceed the amount paid for the specific order in question

Some jurisdictions may not allow certain limitations.

13. Governing Law

These Terms are governed exclusively by the laws of the Commonwealth of Massachusetts, USA.

Hidden Omen does not consent to jurisdiction outside the United States.

Dispute procedures follow the Terms of Service.

14. International Customers & Withdrawal Rights

Hidden Omen is based in the United States. All transactions are subject to U.S. law.

EU / UK Withdrawal Rights Exception

Because all items are made-to-order and “clearly personalized,” the 14-day right of withdrawal does not apply under Directive 2011/83/EU Article 16(c).

This exclusion does not affect your rights related to defective goods under local consumer law.

15. Amendments

We may revise these Terms at any time. The Terms posted at the time of your purchase govern that transaction.
